Whether you ride a traditional bicycle or an electric bicycle, California law gives cyclists many of the same rights and responsibilities as motorists. Understanding these rules can help you ride safely, avoid citations, and protect your rights after a crash.
Important Orange County Bicycle Laws
- Bicycles have the same rights and responsibilities as motor vehicles on California roads, unless a law specifically provides otherwise.
- Drivers should change lanes when passing a bicyclist whenever it is safe and legal to do so. If changing lanes is not possible, motorists must slow to a reasonable and prudent speed and pass only when it can be done safely, providing at least 3 feet of clearance.
- Cyclists may ride two abreast. California law does not prohibit riding side by side. Cyclists may legally ride two abreast when it is safe to do so, including in many bike lanes and travel lanes.
- Cyclists may leave a bike lane to avoid hazards, prepare for a left turn, pass another bicyclist or pedestrian, or when the lane is too narrow for a bicycle and a motor vehicle to safely travel side by side.
- Bicycles ridden at night must have required lights and reflectors. Beginning in 2026, electric bicycles must also have a rear red light or reflector at all times.
- Riders under 18 must wear a properly fitted bicycle helmet.
- Sidewalk and boardwalk bicycle riding is prohibited in many cities, such as Newport Beach, Laguna Beach, and Huntington Beach.

Important Orange County E-Bike Rules
- A legal electric bicycle must have fully operable pedals and a motor producing no more than 750 watts. Depending on its class, motor assistance is limited to either 20 mph (Class 1 and Class 2) or 28 mph while pedaling (Class 3).
- California recognizes three classes of electric bicycles, each with different operating rules and locations where they may legally be ridden.
- Class 3 e-bike riders must be at least 16 years old and wear a helmet.
- A legal e-bike does not require a driver's license, vehicle registration, license plates, or insurance because it is regulated as a bicycle rather than a motor vehicle.
- Not every electric two-wheeled vehicle is a legal e-bike. High-powered electric motorcycles, commonly called e-motos, often exceed California's 750-watt motor limit, lack functional pedals, or reach speeds well above the legal limits for electric bicycles. These vehicles are not legally considered e-bikes, even if they are marketed or sold as one.
- Parents should understand the legal risks. Parents who knowingly allow minors to operate illegal e-motos on public roads may face civil liability and, in some cases, criminal charges if a serious injury or fatal crash occurs.
